The meeting of creditors is when you go to Court. When you file a consumer bankruptcy at some point you will have to go to the 341 meeting of creditors. The layman often refer to it as bankruptcy court. Most of the time this is the only appearance you will make in a Chapter 7 and one of 2 court appearances in a Chapter 13. At this 341 Bankruptcy meeting of creditors you will appear before a panel Trustee. This is not a judge, but a hearing officer whose job it is to carry out the administration of your bankruptcy case. Here in Michigan the Bankruptcy trustees are very efficient and quick.
At this meeting of creditors you will need a photo ID and social security card. There are a list of documents that will need to be provided to the Trustee before the hearing. Most importantly 2 years tax return and 60 days pay stubs. There are other documents that will be needed on a case by case situation. Your attorney will know what they are.
What actually happens at this meeting of creditors is it is an identification process. If they call your case you will give ID and Social Security card then this will ask you a number of questions about your financial condition. It is usually very quick, unless you have assets. Most 341 meetings take about 3 or 4 minutes. If you have issues like real estate, or a business or other assets it could take a lot longer.
Creditors can come and ask questions. You will have to answer all creditors questions under oath. Most of the time creditors do not show up to a 341 meeting of creditors in Michigan.
Depending on where you live will determine where your 341 meeting of creditors will be held. It could be held in Flint, Detroit, Ann Arbor, Bay City or Lansing. Lansing is in the Western District of Michigan. The Western District also holds 341 in Grand Rapids, Kalamazoo, Traverse City, and Marquette, Since I primary deal with bankruptcy cases out of Livingston County, Oakland County, Wastenaw County, Genesee County those are the courts I regularly appear in. But I have been to all of them except Marquette.
Most of my cases go to Flint because Brighton and Howell go to Flint Michigan. White Lake charter Township goes to Detroit
